IHRs not rejected – so where to next for Australia?

No Scrutiny. No Rejection. Now Legally Binding.


Mark Butler, Australia’s Minister for Health, failed to reject the WHO’s WHO’s 2024 International Health Regulations (2024 IHR) by the 19 July 2025 deadline. As a result, these amendments are now internationally binding and must be implemented into Australian law by 19 September 2025 (see p2, A and Article 4, Article 59).


Because the 2024 IHR amendments modify an existing treaty (the IHRs), they do not require fresh ratification. The only form of parliamentary scrutiny is through the review by the Joint Standing Committee onTreaties (JSCT).


Scrutiny that was never intended or deliberately thwarted by bureaucratic process and the convenient cover of an election.



Both the Health Minister and JSCT appear to have hidden behind “process” and the timing of the 2025 federal election to avoid scrutiny and ignore the thousands of Australians who took time to raise their concerns in good faith.


The outcome? Binding obligations with far-reaching implications for Australia’s health laws, adopted without any parliamentary debate or democratic oversight.



The Department of Foreign Affairs confirms that treaties are scrutinised when JSCT’s report is tabled in both houses over 15 - 20 joint sitting days. But JSCT never got to producing its report, which was therefore never tabled.


Here's how that process was deliberately thwarted:


· 19 Sep 2024 – WHO submits final 2024 IHR amendments to Department of Health c/- Minister Butler


· 4 Nov 2024 – Minister refers 2024 IHRs to JSCOT


· 23 Jan 2025 – JSCT invites and public submissions; thousands ofAustralians respond


· 28 Mar 2025 – JSCT’s inquiry lapsed when JSCT is disbanded due to the federal election– JSCT doesn’t complete its report in time for it to be considered by parliament meaning no parliamentary scrutiny


· 19 July 2025 – Deadline to reject 2024 IHR amendments passes without action


The window for rejection has closed. Australians deserve answers.
